ACCESS TO INFORMATION ACT 2016. POPULAR VERSION.

Access to information is a right that promotes the principles of openness and transparency in the running of public affairs. The right is instrumental to the fulfillment of all the other rights in the bill of rights and indeed the realization of the national values and principles of governance set out in Article 10 of Constitution of Kenya, 2010.

For so long, CSOs in Kenya have been involved in a concerted campaign to promote the right to access information and specifically for enactment of a legislative framework for implementation of the right. The campaign that has lasted over a decade has had huge successes including an explicit provision for the right in Article 35 of the Constitution and enactment of Access to Information Act, 2016. Even then, practically, access to information remains one of the most challenging tasks.
